This Policy governs copyright infringement claims relating to:

🪐4. DMCA Notice Procedure (United States & North America)

If you are a copyright owner or authorized agent, you must submit a written notice including:

A. Identification of Copyrighted Work
  • Description of the work claimed to be infringed

  • Registration details (if available)

  • Representative list (if multiple works)

B. Identification of Infringing Material
  • Exact URL(s)

  • Specific location on the Service

  • Any technical identifiers necessary for precise identification

General references are insufficient.

C. Contact Information
  • Full legal name

  • Company name (if applicable)

  • Mailing address

  • Telephone number

  • Email address

D. Required Statements

You must include BOTH:

“I have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.”

“Under penalty of perjury, I declare that the information in this notice is accurate and that I am the copyright owner or authorized to act on behalf of the owner.”

E. Signature

Electronic or physical signature required. 

🪐5. EU Digital Services Act (DSA) Notice-and-Action Procedure

Under Article 16 DSA, notices must contain:

  1. A sufficiently substantiated explanation of why the content is illegal

  2. Clear identification of the exact electronic location

  3. Name and email address of the reporting party

  4. A statement confirming good faith belief in accuracy

If a notice meets DSA standards, it will be considered a “valid notice.”

Upon receipt, we will:

  • Promptly assess the claim

  • Remove or disable access if appropriate

  • Notify the affected user

  • Provide reasoning for decisions

  • Offer appeal mechanisms 

🪐6. Counter-Notification & Appeal Rights

If content is removed or disabled:

Under DMCA:

Users may submit a counter-notification including:

  • Identification of removed material

  • Good faith statement

  • Consent to U.S. federal court jurisdiction

Restoration may occur within 10–14 business days unless legal action is filed.

Under DSA:

Users have the right to:

  • Receive a statement of reasons

  • Submit an internal complaint

  • Access out-of-court dispute settlement

  • Seek judicial redress

We maintain and enforce a Repeat Infringer Policy.

We may:

  • Issue warnings

  • Suspend accounts

  • Permanently terminate accounts

  • Restrict payment access

  • Block IP addresses

  • Prevent re-registration

Determinations are made at our sole discretion based on:

  • Number of valid notices

  • Severity of infringement

  • Pattern of conduct

In accordance with the Digital Services Act, we may:

  • Maintain internal records of notices received

  • Maintain removal logs

  • Cooperate with EU regulatory authorities

  • Publish transparency reports where required   

🪐9. Abuse of Reporting System

Under:

  • DMCA §512(f)

  • Article 20 DSA

Any person who knowingly submits false, misleading, or fraudulent notices may be liable for damages.

We reserve the right to:

  • Reject abusive notices

  • Suspend malicious reporters

  • Seek legal remedies

Unless otherwise required by mandatory law:

  • EU matters governed by Netherlands law

  • U.S. matters governed by applicable federal law
